Managing the problems created by the revisions to the Construction Act
The introduction of the changes to the Housing Grants Construction and Regeneration Act 1996 (the Construction Act) came into force on 1 October 2011. These changes have had a huge impact on the management of payments and adjudications.
Everyone involved in the construction industry needs to act now to ensure they are familiar with how the key changes will affect their business:
- New payment notice provisions (including the right to withhold sums due which will give rise to potential pitfalls)
- Pay when certified banned
- Revised right to suspend work
- Contracts no longer need be in writing expanding both payment and adjudication rights

- Who pays the cost of adjudication
- The adjudicator’s power to correct his decision
